Ítem Judicial review and the reform of article 14º of the Consolidated Text of The Organic Law of the Judiciary.(Facultad de Ciencias Sociales y Jurídicas de la Universidad de Jaén) Quiroga, AníbalThis article analyzes the execution of the judicial review in Peru and its connection to the reform of the Art. 14° of the Consolidated Text of the Organic Law of the Judiciary. It explores the origins of diffuse control in Marbury v. Madison (1803) and its incorporation into Peruvian law since the 1856 Constitution. The study examines Project Bill 09638/2024-CR, which proposes modifying Art. 14 of the LOPJ to transfer the authority to review sentences with diffuse control from the Constitutional and Social Law Chamber of the Supreme Court to the Constitutional Court. The author argues that such a modification cannot be implemented solely through an ordinary law, as it would alter the constitutional distribution of powers. Two potential solutions are presented: (i) A constitutional reform, which would ensure legal coherence but requires a complex and lengthy process; (ii) An amendment to the Organic Law of the Constitutional Court, a quicker alternative but one that cannot override constitutional provisions. The article concludes that a constitutional reform, despite its challenges, is the most appropriate course of action to maintain legal stability and consistency.Ítem López-Sidro López, Á. (2024). Libertad de creencias y adoctrinamiento en un Estado neutral, Iustel, Madrid, España, 205 pp.(Facultad de Ciencias Sociales y Jurídicas de la Universidad de Jaén) Moreno Soler, VíctorÍtem The European Union and the regulation of virtual worlds.(Facultad de Ciencias Sociales y Jurídicas de la Universidad de Jaén) Arce, LorenaThe monograph La Unión Europea and the regulation of virtual Worlds by Dr. Jonatán Cruz Ángeles, Associate Professor of International Public Law and International Relations at the University of Jaén, is an excellent and essential work that immerses us in the complexities and international legal challenges of digital worlds in constant transformation, while shedding light on these issues. In this sense, it is undeniable that digital technologies and worlds are transforming human interaction with the digital and analogue worlds (Introduction, pp. 17-25). Thus, these innovations bring immersive experiences and practical applications to our fingertips in areas as diverse as training, education and even medicine. Although, as the author points out, this new scenario offers us unlimited potential, it is also raising certain questions such as privacy, security, fair competition and social impact, while at the same time opening the way to risks and threats inherent to the digital and global era. The book highlights the urgent need for effective regulation of the Metaverse, which, given its complexity, still looms far over the horizon, while the risks emerge immediately and without delay.Ítem General Council of the Judiciary: From the institutional crisis to the reform?(Facultad de Ciencias Sociales y Jurídicas de la Universidad de Jaén) Martín Gallardo, PascualÍtem The principle of competition and the crime of collusion in public procurement by a local government in Peru(Facultad de Ciencias Sociales y Jurídicas de la Universidad de Jaén) Palomino Flores, HenryÍtem Legal instruments protecting innovative food in the light of the regulation on novel foods in the european union(Facultad de Ciencias Sociales y Jurídicas de la Universidad de Jaén) Mikołaj Sokołowski, ŁukaszÍtem The early maturity of a loan due to non-payment: requirements(Facultad de Ciencias Sociales y Jurídicas de la Universidad de Jaén) Arias-Moral, BeatrizThe ever-present early maturity clauses for non-payment that had been serving as the basis for claims raised by banking entities against those who hold the status of consumers, have been the subject of numerous judicial resolutions in recent years that have declared them null and void. Nullity that has led to the reform of various laws and even the issuance of new ones. What is intended in the following lines, therefore, is to make an analysis of the cases in which the aforementioned clauses are considered valid, of those others in which they are declared abusive and of the consequences derived from such abuse, and of the requirements that, in short, must currently occur for a loan signed between a banking entity and a consumer to be terminated early due to non-payment.Ítem The measures contained in the Draft Organic Law for the protection of minors in digital environments.
