LA INTERVENCIÓN DEL ESTADO EN LOS PROCESOS DE FILIACIÓN

Abstract

El Estado debería intervenir en la dinámica de vida familiar del ser humano y su filiación, cuando haya vulneración o desconocimiento de derechos fundamentales de alguno de los miembros de la familia, en tanto el Estado debe conceder a la familia, como elemento natural y fundamental de la sociedad, la más amplia protección y asistencia posible, especialmente en su preservación y existencia. Tratándose de las acciones de filiación, los agentes del Estado deberían desplegar una serie de poderes, para efectos de resolver el litigio y restablecer derechos. Sería necesario que se defina un modelo de atención de fortalecimiento de los lazos familiares para las familias que se integran a partir de la decisión judicial de filiación -hasta ahora inexistente en Colombia y España- con enfoque de derechos y respeto por la pluralidad, con el propósito de procurar la armonía, unidad y garantizar la dignidad del hijo/a al interior del hogar.

The State should intervene in the dynamics of the family life of the person and the filiation, when there is a vulnerability or ignorance of the human rights of the family members, while the State must bestow to the family, as a natural element and fundamental of society, more protection and assistance, especially in its preservation and existence. In the filiation actions, State agents should have to deploy a series of activities, for the purposes of resolving the litigation and restoring rights. It would be necessary to define a model of family strengthening for who are integrated from the judicial decision of filiation – it’s not existent in Colombia and Spain yet- focus on rights and respect for plurality, in order to go for the harmony, unity and guarantee the dignity of the son and daughter inside the home.
