Derechos de agua, centralización hidráulica y seguridad energética. Una perspectiva desde la justicia hídrica y el litigio ambiental comunitario en México

Abstract

La tesis tiene por objetivo analizar la centralización hidráulica y la seguridad energética como elementos articuladores en el contexto de la política hídrica en México. La investigación propone la reflexión crítica de dichos conceptos bajo la perspectiva de la justicia hídrica y el litigio ambiental comunitario. La tesis está organizada en cinco capítulos y se estructura en torno a cuatro ejes teórico-conceptuales: primero, la tendencia, históricamente acumulada, hacia el centralismo en la política hídrica y la gestión del agua en México; segundo, la justicia hídrica y los derechos comunitarios de agua; tercero, la seguridad energética y el paradigma hegemónico de extracción de minerales e hidrocarburos y, cuarto, el litigio ambiental comunitario frente a proyectos extractivos. El propósito central del trabajo se orienta hacia el diálogo entre la teoría y la praxis, en tal sentido, se documentan dos casos de abogacía pro bono frente a proyectos desarrollados en los ámbitos hídrico y energético: 1) la aprobación y regulación de la fractura hidráulica en México y 2) la instalación y operación del gasoducto industrial de la Huasteca Potosina. La noción de litigio ambiental comunitario se enuncia como un mecanismo contra-hegemónico del uso del derecho, que posibilita la postulación de casos en favor de comunidades agrarias y pueblos indígenas.

The thesis aims to analyze hydraulic centralization and energy security as articulating elements in the context of water policy in Mexico. The research proposes the critical reflection of these concepts from the perspective of water justice and community environmental litigation. The thesis is organized in five chapters and is structured around four theoretical-conceptual axes: first, the historically accumulated trend towards centralism in water policy and water management in Mexico; second, water justice and community water rights; third, energy security and the hegemonic paradigm of mineral and hydrocarbon extraction and, fourth, community environmental litigation against extractive projects. The central purpose of the work is oriented towards the dialogue between theory and praxis, in this sense; two cases about pro bono advocacy are documented against projects developed in the water and energy fields: 1) the approval and regulation of fracking in Mexico and 2) the installation and operation of the Huasteca Potosina industrial gas pipeline. The notion of community environmental litigation is enunciated as a counter-hegemonic mechanism for the use of the law, which enables the submission of cases in favor of agrarian communities and indigenous peoples.
