| dc.description | In the present work, an examination of the changing jurisprudence of the Supreme Court on the irregular stay of foreigners in Spain, as a result of the different sentences issued by the CJEU, is going to be carried out, highlighting the continuous divergent legal approaches. Debate that remains open after the recent ruling of the CJEU dated March 3, 2022 (case C-409/20), which declares the compatibility of the Spanish regime of the sanction of a fine with the Return Directive. Our High Court, in a judgment of March 16, 2022, continues to endorse the non-application of the legal norm that provides for the sanction of a fine for the infraction of irregular stay -art.55.1º.b) LOEX-, by maintaining that the sanction of fine as an alternative to expulsion, clearly violates the Community Directive. | en |
| dc.description | En el presente trabajo se va a realizar un examen de la Jurisprudencia cambiante del Tribunal Supremo sobre la permanencia irregular de los extranjeros en España, a raíz de las distintas sentencias dictadas por el TJUE, resaltando los continuos enfoques jurídicos divergentes. Debate que permanece abierto tras la reciente sentencia del TJUE de fecha 3 de marzo de 2022 (asunto C-409/20), que declara la compatibilidad del régimen español de la sanción de multa con la Directiva de Retorno. Nuestro alto Tribunal, en sentencia de 16 de marzo de 2022, sigue avalando la inaplicación de la norma legal que prevé la sanción de multa para la infracción de estancia irregular, al mantener que la sanción de multa como alternativa a la expulsión vulnera palmariamente la Directiva comunitaria. | es |
