Resumen
[ES]Este trabajo de investigación indaga en los mecanismos preventivos existentes en nuestro ordenamiento para asegurar la posición jurídica del adquirente de vivienda sobre plano. Dado que el acceso a la propiedad se produce por la celebración de un contrato traslativo del dominio, como es la compraventa, seguido de la tradición, hemos juzgado necesario distinguir dos grades bloques: en el primero de ellos se ha estudiado si el carácter proyectado o en construcción del piso (cosa futura) se podía considerar como un posible obstáculo a la eficacia traslativa del instrumento público (esto es, del contrato de compraventa plasmado en documento notarial). En el segundo, se ha analizado el negocio de compraventa de un piso en construcción, desde el prisma puramente contractual, penetrando en el análisis de la naturaleza que tiene tal modalidad contractual.
[EN]This research paper explores the preventive mechanisms in our legal system to ensure the legal position of the home buyers of off-plan properties. Given that access to the property is produced by the celebration of a “traslative contract” of the domain, as it is the sales contract, followed by the “tradition”, we have deemed necessary to distinguish two large blocks: in the first one, it has been studied whether the projected, or under construction, flat’s character (future thing), could be considered as a possible obstacle to the translational efficiency of the public instrument (that is, the sales contract expressed in notarial document). In the second, it has been analyzed the business of a sales contract under construction, through the prism purely contractual, deeping in the analysis of the nature that has such a contractual type.
