EL ORDEN SOCIAL COMO JURISDICCIÓN INTEGRAL DEL EMPLEO PÚBLICO: BALANCE Y PROPUESTA A LA LUZ DE LA EXPERIENCIA DE LA PREVENCIÓN DE RIESGOS LABORALES

Abstract

La revisión del mapa competencial establecido para la jurisdicción social, las luces y sombras alcanzadas con la prevención de riesgos laborales y la evolución interpretativa y legislativa, constituyen una expresión clara e inexorable de la necesidad, de promover una genuina jurisdicción social del empleo público, al margen de la naturaleza del vínculo de empleo (laboral o funcionarial, incluido el estatutario) y de la fuente reguladora de condiciones y derechos del personal, incluso de la dimensión individual o colectiva del conflicto. El orden social debe ser la jurisdicción integral del empleo público no solo el civil, en especial cuando se trate de unos asuntos directamente vinculados a condiciones de trabajo y también de la protección social, por imperativos de unidad, especialidad y por exigencias de efectividad de la tutela judicial de derechos sociales que conllevaría una histórica ampliación de competencias para la que no basta la apertura de criterios interpretativos, sino que requiere una reforma del derecho legislado.

The review of the competence map established for social jurisdiction, the lights and shadows achieved with the labo risks prevention and the interpretative and legislative evolution, constitute a clear and inexorable expression of the need to promote a genuine social jurisdiction of public employment, by regardless of the nature of the employment relationship (labor or civil servant, even statutory) and the regulatory source of conditions and rights of the staff, even the individual or collective dimension of the conflict. The social order must be the comprehensive jurisdiction of public employment, not just civil employment, and especially when it comes to subjects directly connected to working conditions and also social protection, due to imperatives of unity, specialty and effectiveness requirements of the judicial protection of social rights. These issues would lead to a historic expansion of responsibilities for which the opening of interpretative criteria is not enough but requires a reform of legislated law.
