EL PERFECCIONAMIENTO DEL CONTRATO ELECTRÓNICO EN DERECHO INTERNACIONAL PRIVADO ESPAÑOL

Abstract

Esta tesis trata el tema del perfeccionamiento del contrato electrónico como etapa necesaria para su conclusión. Este asunto presenta peculiaridades, porque en la contratación electrónica la perfección del contrato no se produce instantáneamente, a diferencia de la contratación realizada entre las partes presentes. Además, es común el uso de las condiciones generales del contrato que deben aceptarse para que el contrato se perfeccione. En la investigación realizada se parte de la hipótesis de que en Derecho internacional privado la cuestión del perfeccionamiento del contrato esta en determinar las etapas en los que se lleva a cabo e indicar su régimen legal. Esta labor, puede resultar compleja por el diferente origen y objeto de las fuentes jurídicas de las que emanan estas normas que por un lado regulan estas materias desde un punto de vista horizontal pero inciden en el perfeccionamiento del contrato electrónico con carácter interseccional.

This thesis is about the perfection of the electronic contract as a necessary stage for its conclusion. This matter presents peculiarities, because in electronic contracting the perfection of the contract does not occur instantaneously, as the contracting made between the parties present. In addition, it is common to use the general conditions of the contract that must be accepted for the contract to be perfected. The research carried out is based on the hypothesis that in private international law the question of the perfection of the contract is to determine the stages in which it is carried out and indicate its legal regime. This work may be complex because of the different origin and purpose of the legal sources from which these standards emanate, which on the one hand regulate these matters from a horizontal point of view but affect the improvement of the electronic contract with an intersectional nature.
