EL RECONOCIMIENTO ENTRE ESPAÑA Y MARRUECOS DE LAS DECISIONES JUDICIALES EN EL ÁMBITO DE LA DISOLUCIÓN DEL MATRIMONIO: DESDE UNA PERSPECTIVA COMPARADA

Abstract

El reconocimiento de las decisiones judiciales entre España y Marruecos en materia de disolución del matrimonio y alguno de sus efectos requiere, en la actualidad, un tratamiento muy específico acorde con la función que está marcando el entero sistema de DIPr que es la máxima protección, realización y satisfacción de los derechos humanos y fundamentales de las personas inmigrantes. El método comparado, concretamente, el método funcional y la equivalencia funcional permiten una nueva interpretación del sistema del DIPr de ambos países. De forma específica, se destaca la técnica de la equivalencia funcional y su impacto sobre la interpretación de las condiciones para el reconocimiento de las decisiones entre ambos ordenamientos, en particular, el orden público. The recognition of judicial decisions between Spain and Morocco on the dissolution of marriage and some of its effects requires, at present, a very specific treatment in accordance with the current function of the entire Private International Law System, which is the maximum protection, realisation and satisfaction of the human and fundamental rights of immigrants. The comparative method, specifically the functional method and functional equivalence, allow for a new interpretation of the Private International Law System in both countries. The technique of functional equivalence and its impact on the interpretation of the conditions for the recognition of decisions between the two legal systems, specifically, public policy, are highlighted.
