PERFIL PSICOSOCIAL Y JURÍDICO DE MENORES QUE CUMPLEN MEDIDAS JUDICIALES POR DELITO DE MALTRATO FAMILIAR

Abstract

El propósito de esta Tesis Doctoral ha sido el de profundizar en el conocimiento de la violencia filio-parental (VFP), un tipo de violencia en el contexto familiar en la que tanto hijos como hijas ejercen conductas de maltrato hacia sus padres y madres de tipo física, psicológica, económica y de control/dominio. Esta tesis está estructurada en dos partes: una teórica donde se repasan los contenidos relacionados con su definición, tipos de violencia, marco legal y jurídico, teorías explicativas y otra parte empírica donde se recogen tres estudios con tres grupos de personas adolescentes: un grupo de personas menores infractoras con delito de maltrato familiar, otro grupo con otros delitos y un tercer grupo sin delitos. La muestra está formada por 300 personas adolescentes, de las que 80 pertenecían al grupo de delito por maltrato familiar, 109 pertenecían al grupo de otros delitos mientras que 111 pertenecían al grupo sin delitos. El objetivo principal de esta Tesis Doctoral fue examinar el papel de variables de tipo individual (género del agresor o agresora, edad, tipos y razones para la violencia, impulsividad, consumo de sustancias, justificación de la violencia, procesamiento de la información social, estilos de apego parental y empatía) familiar (género de la víctima, estructura familiar y estilos educativos) y social (grupo de iguales y exposición a la violencia) en la VFP. Se analizan también las posibles diferencias en función del género. The purpose of this Doctoral Thesis has been to deepen the knowledge of child-to-parent violence (CPV), a type of violence in the family context in which both sons and daughters exercise abusive behavior towards their fathers and mothers physical, psychological, economic and control/domain. This Thesis is structured in two parts: a theoretical part where the contents related to its definition, types of violence, legal and juridical framework, explanatory theories are reviewed and another empirical part where three studies with three groups of adolescents are collected: a group of adolescent offenders with the crime of family abuse, another group with other crimes and a third group without crimes. The sample is made up of 300 adolescents, of which 80 belonged to the group of crimes due to family abuse, 109 belonged to the group of other crimes while 111 belonged to the group without crimes. The main objective of this Doctoral Thesis was to examine the role of individual variables (gender of the aggressor, age, types and reasons for violence, impulsivity, substance consumption, justification of violence, social information processing, styles of parental attachment and empathy), family (gender of the victim, family structure and educational styles) and social (peer group and exposure to violence) in CPV. Possible differences based on gender are also analyzed.
